These Terms of Service govern your use of the website located at https://jencunningham.co.uk and any related services provided by Jen Cunningham.

By accessing https://jencunningham.co.uk, you agree to abide by these Terms of Service and to comply with all applicable laws and regulations. If you do not agree with these Terms of Service, you are prohibited from using or accessing this website or using any other services provided by Jen Cunningham.

We, Jen Cunningham, reserve the right to review and amend any of these Terms of Service at our sole discretion. Upon doing so, we will update this page. Any changes to these Terms of Service will take effect immediately from the date of publication.

Stock Levels

Any piece showing as “in stock” is available to buy. Please contact me before ordering if you need it before a certain date so I can confirm if I can post it in time. Any jewellery “out of stock” but available for back order (pre-order) I'll make to order; please allow a 2 – 5 week making time.

I'll endeavour to ensure the stock on my website is an accurate reflection of what I have available, at times there may be a variation between what I have in stock and what shows on the website. I’ll offer a refund if you purchase anything that is out of stock if you don’t want to wait for it to be made and/or if I no longer make the item.

My rings and bangles are mostly handmade; other jewellery is cast or has cast parts. This helps reduce the making time and therefore the cost to you! The castings are made from masters I make, which are then cast by UK based companies who are committed to using recycled precious metals.

What is a bespoke or commissioned piece of jewellery?

A "bespoke" or "commission" is any jewellery that's customised or personalised. This includes, but isn't limited to; engravings, different landscapes, addition of stones, and different precious metals. All customisation and personalisation will incur a surcharge. Please ask if you want to know more about my design charges or engraving costs.

To confirm an order a 40% non-refundable deposit must be paid, the design can't be changed after this. Any remaining payments must be paid and funds cleared before goods are dispatched.

Bespoke/commissioned items are non-refundable and non-returnable. If you're unsure of sizing please chat to me about this during the design stage.

The final price may change if your bespoke jewellery is being cast.

Using your own metal in bespoke jewellery

If you’re having your own jewellery and/or stones remodelled into a new piece of jewellery, I can’t be held responsible for any hallmarking failures or for any faults in the metal or stones.

Sometimes jewellery which is thought to be precious metal fails assay at the point of hallmarking, either to a lower standard than was thought, or it might fail altogether. If there isn't an assay mark on your jewellery or metal I can get it tested, if needed, at an additional cost. Precious metal and jewellery can fail to melt correctly or crack and break despite my best efforts. If such a situation arises I won't be held responsible for the failures within the metal. This might mean we can't use the metal you've supplied and I’ll discuss the different options with you before going ahead with any more work.

Removing stones from jewellery for remodelling is a difficult process; the stones might be chipped or broken already. I’ll check over the stones before unseating them and let you know if I see any issues. Some issues might not be visible until the stones are out. For example there could be a crack through the whole stone but it can look fine when still set in the old jewellery. I'll let you know how they're looking once I’ve cleaned them up. Diamonds and other hard stones are not indestructible and can be chipped and broken through the force of setting them into the metal. I’ll always be honest and upfront about any damage or breakages if they occur.

Guarantees

Each piece of jewellery is made by me, either by hand, or from cast elements that I hand finish. This means the jewellery you order may differ slightly from the photographs on the website. All pieces have a guarantee against manufacturing flaws. I'll repair any piece of jewellery I've made for free if, upon assessing it in person, I deem the repair due to a manufacturing flaw. This is part of my commitment to offer quality jewellery. Delivery/postage costs are not included.

Manufacturing flaws include dry solder joints which are easy for me to distinguish from wear and tear. This guarantee does not include general wear and tear, oxidisation or platings, or misuse or mistreatment of jewellery. Please contact me before sending jewellery for assessment and post them using Royal Mail Special Delivery to ensure the jewellery has the correct insurance.

Care for your jewellery

Treat your jewellery with care.

  • It should be the last thing to go on, and the first thing you take off.

  • Do not wear jewellery in the shower or when washing your hands.

  • Do not expose it to bright sunlight or heat as this can speed up the tarnishing process.

  • Remove jewellery before exercise or swimming.

  • Do not spray perfumes or use lotions on or near your jewellery, let them dry before putting on your jewellery.

The body's natural oils and sweat can affect the precious metal in your jewellery. To keep it looking its best, give it a regular rinse with warm water with the occasional addition of mild washing up soap. To clean tarnished jewellery, use some washing up soap, warm water and kitchen paper or a very soft toothbrush to clean it. Don't use abrasive materials; these will scratch the surface of your jewellery. To remove ingrained dirt carefully soak your jewellery in hand-hot water and dish soap before cleaning with a soft toothbrush. Submerge stones in water at your own risk. You can wash matte items with a soft toothbrush. Please avoid getting plated or oxidised areas of jewellery wet, or cleaning them as this will take off the plating.

If you don’t feel comfortable cleaning your jewellery, or want it freshened up for an event, I offer a clean + polish service which you can order in my shop.

Limitations of Use

By using this website, you warrant on behalf of yourself, your users, and other parties you represent that you will not:

  1. modify, copy, prepare derivative works of, decompile, or reverse engineer any materials and software contained on this website;

  2. remove any copyright or other proprietary notations from any materials and software on this website;

  3. transfer the materials to another person or “mirror” the materials on any other server;

  4. knowingly or negligently use this website or any of its associated services in a way that abuses or disrupts our networks or any other service Jen Cunningham provides;

  5. use this website or its associated services to transmit or publish any harassing, indecent, obscene, fraudulent, or unlawful material;

  6. use this website or its associated services in violation of any applicable laws or regulations;

  7. use this website in conjunction with sending unauthorised advertising or spam;

  8. harvest, collect or gather user data without the user’s consent; or

  9. use this website or its associated services in such a way that may infringe the privacy, intellectual property rights, or other rights of third parties.

Intellectual Property

The intellectual property in the materials contained in this website are owned by or licensed to Jen Cunningham and are protected by applicable copyright and trademark law. We grant our users permission to download one copy of the materials for personal, non-commercial transitory use.

This constitutes the grant of a license, not a transfer of title. This license shall automatically terminate if you violate any of these restrictions or the Terms of Service, and may be terminated by Jen Cunningham at any time.

User-Generated Content

You retain your intellectual property ownership rights over content you submit to us for publication on our website. We will never claim ownership of your content but we do require a license from you in order to use it.

When you use our website or its associated services to post, upload, share or otherwise transmit content covered by intellectual property rights, you grant to us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use, distribute, modify, run, copy, publicly display, translate or otherwise create derivative works of your content in a manner that is consistent with your privacy preferences and our Privacy Policy.

The license you grant us can be terminated at any time by deleting your content or account. However, to the extent that we (or our partners) have used your content in connection with commercial or sponsored content, the license will continue until the relevant commercial or post has been discontinued by us.

You give us permission to use your username and other identifying information associated with your account in a manner that is consistent with your privacy preferences and our Privacy Policy.

Photography of jewellery sent by clients has been used in good faith, if you wish to have your images removed please contact me.

Liability

Our website and the materials on our website are provided on an 'as is' basis. To the extent permitted by law, Jen Cunningham makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property, or other violation of rights.

In no event shall Jen Cunningham or its suppliers be liable for any consequential loss suffered or incurred by you or any third party arising from the use or inability to use this website or the materials on this website, even if Jen Cunningham or an authorised representative has been notified, orally or in writing, of the possibility of such damage.

In the context of this agreement, “consequential loss” includes any consequential loss, indirect loss, real or anticipated loss of profit, loss of benefit, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings, loss of reputation, loss of use and/or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity or otherwise.

Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

The materials appearing on our website are not comprehensive and are for general information purposes only. Jen Cunningham does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on this website, or otherwise relating to such materials or on any resources linked to this website.

Right to Terminate

We may suspend or terminate your right to use our website and terminate these Terms of Service immediately upon written notice to you for any breach of these Terms of Service.

Severance

Any term of these Terms of Service which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity of the remainder of these Terms of Service is not affected.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Scotland, United Kingdom. You irrevocably submit to the exclusive jurisdiction of the courts in that country.
